Consideration of Amendment to Forsyth County Enabling Legislation

Update: This item was approved by the Board of Commissioners at their meeting October 19, 2017.

The Forsyth County Board of Commissioners will consider amendments to Section 12.1 of the Act creating the Board of Commissioners of Forsyth County, Georgia, approved June 30, 1964 (Ga. L. 1964, Ex. Sess., p. 2225), as amended, pursuant to the Georgia Constitution, Article IX, Section II, Paragraph I of the Constitution of the State of Georgia at the board’s regular meetings on October 5, 2017 and October 19, 2017 at 5 p.m. in the Commissioners’ Meeting Room, Suite 220 in the Forsyth County Administration Building located at 110 East Main Street, Cumming, Georgia 30040.

The proposed amendment shall modify the procedures related to the exercise of the police powers by the Board of Commissioners. Specifically, the proposed amendment will change the public hearing requirements necessary for adoption of ordinances or resolutions that serve as a basis for a prosecutable code violation, by changing the public hearing requirements from two consecutive public hearings to two public hearings without the consecutive requirement.  Copies of the proposed amendment (as reflected in the Resolution and Ordinance of Amendment) are on file in the Office of the Clerk of Superior Court of Forsyth County and the Forsyth County Administrative Clerk.
