(1) City/County discussion regarding whether to levy and collect an excise tax within the special district upon the sale or use of energy, when such sale or use would have constituted a taxable event for purposes of sales and use tax under Article 1 of Chapter 8 of Title 48 but for the exemption in O.C.G.A. § 48-8-3.2 and the possible creation of an Intergovernmental Agreement regarding distribution of proceeds from any energy excise tax – County Attorney
Without exception this item will be added to the 10/09/12 Work Session Agenda.
(2) Review of request by the Grand Cascades Community Association for the county to sponsor a 319(h) grant for storm water facility remediation – Commissioners Boff/Levent
(Previously discussed @ 03/06/12, 04/24/12, 07/24/12, 08/07/12 and 08/28/12 Work Sessions).
Approved 4-1 (Commissioner Bell opposed). Due to a 4-1 vote, this item will be placed on the September 20, 2012 agenda as “New Business”.

(3) Consideration of a Resolution establishing the Secondary Metals Recycler Registration Fee – County Attorney
Unanimously voted to Table.
(4) Acceptance of the State of Georgia Department of Transportation 2012-2013 Transit Operating Assistance Grant Program in the amount of $266,580 with a required match of $266,580 and authorization for the Chairman to execute any related application documents – Grants Manager
Unanimously approved as Time Sensitive.
(5) Request authorization to replace one Sheriff’s Office Patrol Vehicle – Risk Manager
Unanimously approved as Time Sensitive.
(6) Request approval of a Lease Agreement between Forsyth and Webb-Daniel Partnership, LLP for property located @ 304 West Main Street for the purpose of relocating the Indigent Defense Department – Director of Public Facilities
Unanimously approved as Time Sensitive.
(7) Agreement between Sawnee EMC and Forsyth County as follows: (Fire Chief Bowman)
(i) Request permission to remove from the table the Sawnee EMC Agreement for electric service to new Fire Station 4 (Ducktown) - previously tabled July 10, 2012.
Unanimously approved as Time Sensitive.
(ii) Request approval of Agreement between Sawnee EMC and Forsyth County for electric service to new Fire Station 4 (Ducktown) with authorization to pay the required Contribution in Aid in the amount of $1,530.00.
Unanimously approved as Time Sensitive.
(iii) Request approval of right of way easement between Sawnee EMC and Forsyth County for property located at 5910 Evans Road, Cumming, Georgia to provide electric service to new Fire Station 4 (Ducktown).
Unanimously approved as Time Sensitive.
(8) Atlanta Gas Light Natural Gas Agreement for Fire Station 4 – Procurement Director
Unanimously approved as Time Sensitive.
(9) Acceptance of RFP 12-59-1500 for Architectural/Engineering Services for the Jail/Courthouse Project – Procurement Director
Unanimously approved.

(10) Presentation of 2013 benefits contribution options by Northwestern Benefit – Director of Personnel Services
Unanimously approved the rates as Time Sensitive
(11) Discussion of 2013 compensation for County Coroner position – Director of Personnel Services
Postponed to 09/25/12.
(12) Discussion of 2013 local supplement compensation for position of County Sheriff – Director of Personnel Services
Unanimously voted to not approve a supplement for the next term.
(13) Consideration of waiving the fee for a zoning condition amendment placed on ZA1969 by Sheri Hudson (Horse Pro Trailers) – District #4 – Director of Planning & Community Development
Unanimously approved.
(14) Board consideration of extending existing Service Delivery Strategy between Forsyth County and the City of Cumming – County Manager
Postponed to 09/25/12.
(15) County consideration of donation of property located at McGinnis Ferry Road and Caney Creek – County Attorney/Director of Engineering
(Postponed from 08/28/12 Work Session).
Unanimously approved to accept property with the understanding that the County will pay their share of school and state taxes owed.
(16) Approval and execution of contract between Georgia Department of Transportation and Forsyth County for acquisition of right of way, Project #CSSTP-0009-00(316) Bethelview Road widening from Castleberry Road to SR 20 – Director of Engineering
Unanimously approved.
(17) Local Option Sales Tax (LOST) Renegotiation Update – County Manager
(Previously discussed at 08/16/12 Regular Meeting – postponed from 08/28/12 Work Session).

(18) Proposed Intergovernmental Agreement between the City and County for acquisition of Real Estate – County Attorney
(Postponed from 08/07/12 and 08/28/12 Work Sessions).

(19) Board consideration and possible approval of Quit Claim Deed releasing liens on property belonging to Sairam Pamulapati and Sabitha Pamulapati – County Attorney
