Call Meeting to Order

Adoption of Agenda – Adopted with changes.

Announcements and Reports:

(1) Presentation of longevity service awards to those employees having reached twenty (20) or more years of service during the first quarter of 2009 – Director of Personnel Services.

Public Comments – 9 speakers.

Adoption of Minutes:

(1) Executive Session of April 1, 2009.
Adopted.

(2) Regular Meeting/Public Hearings and Executive Session of April 2, 2009.
Adopted.

(3) Work Session and Executive Session of April 7, 2009.
Adopted.

Consent Agenda:

(1) Adoption of Resolutions authorizing Affidavits concerning Executive Sessions of April 1, 2009, April 2, 2009 and April 7, 2009.
Adopted.

(2) The following items were discussed and unanimously approved at a Work Session held on April 7, 2009:

(A) Approval to apply for the Edward Byrne Memorial Justice Assistance Grant in the amount of $300,000 to provide funding for the purchase of an electronic ticketing system – no match required – Captain Mike Honiker.
Approved.

(B) Approval to apply for the Section 5311 Rural Federal Transit Funds from the Georgia Department of Transportation in the amount of $70,000 to construct a transit vehicle shelter to house Dial-A-Ride vans – no match required - Grants Administrator.
Moved to New Business #4.

(C) Approval to apply for the Preservation Assistance Grant for Smaller Institutions from the National Endowment for the Humanities in the amount of $6,000 for the preservation of county deed books and records dating back to 1832 – no match required - Grants Administrator.
Approved.

(D) Renewal of Mobile (Crime Agent/IPSP), RMS/JMS, and Radio IP Software Maintenance with Interact Public Safety Systems for the IT Department – Procurement Director.
Approved.

(3) Added to the Consent Agenda:
Reappointment of Robert (Bob) Charles to the Board of Ethics – County Manager.

VIII. Public Hearings:

(1) Proposed Red Flag Ordinance – County Attorney.
Public Hearing held – Adopted Ordinance.

(2) Request by the Sheriff’s Office to apply for the Edward Byrne Memorial Justice Assistance Formula Grant in the amount of $79,962 with no match – grant will provide for an inmate tracking system, VINE system and cyber crime equipment – Captain Mike Honiker.
Public Hearing held – Authorized Sheriff’s Office to apply for the Edward Byrne Memorial Justice Assistance Formula Grant – no match.

IX. Old Business:

(1) Rezoning request: (Director of Planning & Development)

(A) Sobh Automotive of Cumming, Inc., ZA3510, A1/CBD to CBD with variances – District #2.
(Postponed from 02/19/09, 03/05/09; 03/19/09 and 04/02/09 Agendas)
MOVED TO END OF NEW BUSINESS.
Approved with conditions and variances.

(2) Request by Ethan Underwood on behalf of Diversified Real Estate Group, LLC for a Public Hearing regarding the denial of an Administrative Appeal by the Board of Appeals on March 3, 2009 on AB# AP090002 – District #3 - Director of Planning & Development.
(Postponed from 04/02/09 Agenda).
TABLED.

(3) Consideration of funding proposals for two (2) South Recreation Centers - Chief Financial Officer.
Postponed to 05/07/09.

(4) Request by Windermere Village Associates, LLC for an additional ninety (90) day payment extension for sewer capacity – Director of Water & Sewer.
Approved an additional 90 day extension.

New Business:

(1) Approval of Memorandum of Understanding between Forsyth County and the 1071 Coalition – Commissioner Tam.
(Previously discussed at a Work Session held on 04/07/09).
Approved.

(2) Approval of Memorandum of Understanding between Forsyth County and the Lake Lanier Association – County Attorney.
(Previously discussed at a Work Session held on 04/07/09).
Approved.

(3) Approval to apply for the COPS Hiring Recovery Program in the amount of $4,691,724 to fund salaries and benefits for 46 officers – requires a county match of $2.6 million – Captain Mike Honiker.
(Previously discussed at a Work Session held on 04/07/09).
Authorized Sheriff’s Office to apply for the COPS Hiring Recovery Program.


(4) MOVED FROM CONSENT AGENDA 2-B:
Approval to apply for the Section 5311 Rural Federal Transit Funds from the Georgia Department of Transportation in the amount of $70,000 to construct a transit vehicle shelter to house Dial-A-Ride vans – no match required - Grants Administrator.
The Grant application was changed to the amount of $176,100 for the replacement of three (3) Dial-a-Ride vans, video surveillance cameras, computer & printer, GPS Systems and Fare Boxes.
Authorized Grants Administrator to apply for the Section 5311 Rural Federal Transit Funds Grant.

(5) Added to agenda as an emergency item:
Assignment of Contractual Sewer Rights and Security Agreement between Jim Cowart Residential, LLC and New South Federal Savings Bank – County Attorney.
Postponed to April 21, 2009 Work Session Agenda.

(1) Hearings in reference to alleged alcohol ordinance violations: (County Attorney)

(A) Oscarville – Named Licensee is Choon Wha Shin – District #4.
Suspended license for six (6) months.

(B) S Sarang, Inc. d/b/a Thomas Chevron – Named Licensee is Seung K. Lee – District #2.
Suspended license for 60 days.
