1. At the December 9, 2008 work session meeting, the application of CP080011 (Phoenix Youth Ranch, Inc.) was postponed by the Planning Commission until the January 27, 2009 meeting.
2. The application of ZA3411 (Paces Battle Properties, LLC) has been postponed by staff due to the need for further details regarding the Master Planned District (MPD) until the January 27, 2009 meeting.
3. At the December 9, 2008 work session meeting, the application of ZA3463 (Mathis Crossing, LLC) was postponed by the Planning Commission until the January 27, 2009 meeting.
4. At the November 18, 2008 work session meeting, the application of ZA3474 (Atlanta Road, LLC) was postponed by the Planning Commission until the January 27, 2009 meeting.

VII. PUBLIC HEARINGS FOR CONDITIONAL USE PERMITS
1. Robert M. Baines CP080004 Applicant is requesting a Conditional Use Permit (CUP) for a school affiliated with an existing church with a building area of 8,000 square feet and 50 parking spaces on 5.679 acres Location: At 7110 Majors Road in Cumming. This property is located in Commission District #3.
2. Phoenix Youth Ranch, Inc. CP080011 Applicant is requesting a Conditional Use Permit (CUP) on property zoned A1 for a therapeutic ranch for abused children (non-profit membership group) on 17.4 acres Location: On the south side of Keith Bridge Road approximately 1,200 feet east of the intersection with Little Mill Road. This property is located in Commission District #4.
3. Lindley Development, LLC CP080012 Applicant is requesting a Conditional Use Permit (CUP) to develop a 45 unit, 18,300 square foot personal care home/institutionalized living facility with 51 parking spaces on property zoned R3 with a density of 5.27 units per acre on 8.724 acres. The applicant is also requesting a variance to the rear yard setback of 15 feet to allow a rear yard setback of 10 feet. Location: In the southwest corner of Jot Em Down Road and Cantrell Road with Blue Ridge Overlook. This property is located in Commission District #4.

Paces Battle Properties, LLC ZA3411 Rezone from A1 to MPD on 239.855 acres Location: On the north side of Atlanta Highway (S.R. 9) approximately 1,000 feet southeast of the intersection with Castleberry Road and on the southeast side of Castleberry Road approximately 585 feet from the intersection with Majors Road and on the south side of Majors Road approximately 800 feet from the intersection with Castleberry Road. This property is located in Commission District #3.
2. Mathis Crossing, LLC ZA3463 Rezone from A1/NS to CBD for the development of a 4,400 square foot building with 21 parking spaces on 1.066 acres Location: On the west side of Old Atlanta Road at the intersection with Windermere Parkway and on the east side of Mathis Airport Parkway at the intersection with Windermere Parkway. This property is located in Commission District #2.
3. Atlanta Road, LLC ZA3474 Rezone from R1 to M2 with a Conditional Use Permit (CUP) for a construction and demolition (C&D) landfill with 5 parking spaces on 22.39 acres Location: On the southeast side of Georgia Highway 400 approximately 2,268 feet southwest from the intersection of North Old Atlanta Road and Georgia Highway 400 and on the northwest side of Ronald Reagan Boulevard, approximately 1,633 feet south from the intersection of North Old Atlanta Road and Ronald Reagan Boulevard. This property is located in Commission District #1.
4. Brad Hartner ZA3507 Rezone from LR/R2R to A1 for agricultural use on 10.01 acres Location: In the northeast corner of Holland Drive and Robbs Crossing Drive. This property is located in Commission District #5.

Lindley Development, LLC ZA3508 Rezone from A1/R3 to NS for the development of 74,150 square feet of retail and restaurant space with 367 parking spaces on 16.003 acres Location: On the south side of Jot Em Down Road approximately 1550 feet west of the intersection with Blue Ridge Overlook and on the west side of Jot Em Down Road approximately 585 feet south of the intersection with Cantrell Road. This property is located in Commission District #4.
