III. Announcements

Pursuant to Section 8-3.4 (E) of the Unified Development Code of Forsyth County, the findings and decisions of the Zoning Board of Appeals shall be final unless a person aggrieved shall, within ten (10) days of such decision, petition the Board of Commissioners of Forsyth County to review the decision. At the end of the (10) day period, it shall be the responsibility of each applicant to check with the Department of Planning and Development to confirm whether or not such an appeal has been made.

Pursuant to Section 8-3.4 (B) of the Unified Development Code of Forsyth County, persons wishing to speak on any proposal shall provide their name, address, and telephone number to the Department of Planning and Development staff prior to the time of speaking at this public hearing. You may obtain a copy of this form in the foyer of this meeting room.

APPEALS OF ADMINISTRATIVE DECISIONS
1. AP080006 - Northridge Homes LLC
This request involves an appeal of an administrative decision of the Forsyth County Department of Planning and Development.

The property is located in Hannah's Crossing Subdivision, Lot #27 and 29, 9115 Kate Court and 9035 Hannah's Crossing Drive and is currently zoned RES2 - Single Family Residential Two Units/Acre District. This property is in Commission District #4.
VARIANCES
1. VA080066 - Curt Cooper
This request involves an exterior yard variance of 30 feet to allow a swimming pool to be built 20 feet from the exterior property line and a home to remain 42 feet from the exterior property line rather than the required 50 feet. The applicant also requested a side yard variance of 4 feet to allow a garage to be built 6 feet from the side property line rather than the required 10 feet.

The property is located in Three Chimneys Farm Subdivision, Lot 121, 4325 Woodward Way and is currently zoned CR1 - Single Family Community Residential District. This property is in Commission District #2.


2. VA080070 - Michael T. Martin
This request involves a side yard variance of 35 feet to allow recreational infrastructure to be built 15 feet from the side property line rather than the required 50 feet. This request involves utilizing on-site sewage disposal in lieu of public sewer; a distance variance of 5000 feet.

The property is located on the south side of Gilbert Road approximately 250 feet west of Portsmouth Lane and is currently zoned Res2 - Single Family Residential Two Units/Acre District. This property is in Commission District #5.
4. VA080072 - Deborah Jarrett
This request involves a rear yard variance of 20 feet to allow a waterfall/pool apparatus to remain 5 feet from the rear property line rather than the required 25 feet.

The property is located in Windermere Subdivision, Lot #366, 1410 Elgin Way and is currently zoned CR1 - Single Family Community Residential District. This property is in Commission District #5.
5. VA080073 - Mildred E. Cook
This request involves a side yard variance of 9 feet to allow a carport to remain 1 foot from the side property line rather than the required 10 feet. The applicant is also requesting a rear yard variance of 17 feet to allow a deck to remain 8 feet from the rear property line and a home to remain 18 feet from the rear property line rather than the required 25 feet.

The property is located in Crystal Cove Shores Subdivision, Lot #202, 6660 Sawnee Way and is currently zoned LR - Lake Residential District. This property is in Commission District #4.
6. VA080074 - Midway Kids Village, LLC
This request involves a landscape strip variance of 4 feet to allow a landscape strip to be 6 feet rather than the required 10 feet.

7. VA080075 - Habersham Partners 33, LLC
This request involves a side yard variance of 40 feet to allow a commercial building and parking area to be built 10 feet from the side property line rather than the required 50 feet. The applicant is also requesting a buffer variance of 40 feet to allow a buffer to be 0 feet rather than the required 40 feet.
