1. The application of ZA3411 (Paces Battle Properties, LLC) has been postponed by staff due to the need for further details regarding the Master Planned District (MPD) until the December 16, 2008 meeting.
2. At the September 23, 2008 meeting the application of ZA3463 (Mathis Crossing, LLC) was postponed by the Planning Commission until the December 16, 2008 meeting.
3. The application of ZA3474 (Atlanta Road, LLC) has been postponed by the Planning Commission until the January 27, 2009 meeting.

VII. PUBLIC HEARINGS FOR CONDITIONAL USE PERMITS
1. Charles & Marjorie Mann Charitable Foundation, Inc. CP080007 Applicant is requesting a Conditional Use Permit (CUP) to develop property currently zoned CBD for a Continuing Care Retirement Community (CCRC) for 275,572 square feet of building area with 253 parking spaces on 13.00 acres. The applicant is also requesting a variance to the exterior yard of 40 feet to allow an exterior yard setback of 10 feet and a variance to the exterior buffer of 15 feet to allow for a 10 foot buffer. Location: On the west side of North Old Atlanta Road approximately 230 feet north of the intersection with Georgia Highway 400 and on the east side of Atlanta Highway (S.R. 9) approximately 300 feet southwest from the intersection with Greenfield Drive. This property is located in Commission District #1.

1. Paces Battle Properties, LLC ZA3411 Rezone from A1 to MPD on 239.855 acres Location: On the north side of Atlanta Highway (S.R. 9) approximately 1,000 feet southeast of the intersection with Castleberry Road and on the southeast side of Castleberry Road approximately 585 feet from the intersection with Majors Road and on the south side of Majors Road approximately 800 feet from the intersection with Castleberry Road. This property is located in Commission District #3.
2. Mathis Crossing, LLC ZA3463 Rezone from A1/NS to CBD for the development of a 4,400 square foot building with 21 parking spaces on 1.066 acres Location: On the west side of Old Atlanta Road at the intersection with Windermere Parkway and on the east side of Mathis Airport Parkway at the intersection with Windermere Parkway. This property is located in Commission District #2.
3. Arlene Harrison Estate ZA3468 Rezone from A1 to MPD (Master Planned District) for a mixed use development consisting of 634,500 square feet of commercial with 2,623 parking spaces, and a residential component consisting of 183 single family detached and 141 townhomes with a residential density of 4.85 units per acre and an overall density of 2.09 units per acre on a total of 155.39 acres Location: In the northwest corner of Peachtree Parkway (S.R. 141) at the intersection with Brookwood Road and Caney Road, and on the west side of Caney Road approximately 500 feet south of the intersection with Christopher Robin Road. This property is located in Commission District #2.
4. Atlanta Road, LLC ZA3474 Rezone from R1 to M2 with a Conditional Use Permit (CUP) for a construction and demolition (C&D) landfill with 5 parking spaces on 22.39 acres Location: On the southeast side of Georgia Highway 400 approximately 2,268 feet southwest from the intersection of North Old Atlanta Road and Georgia Highway 400 and on the northwest side of Ronald Reagan Boulevard, approximately 1,633 feet south from the intersection of North Old Atlanta Road and Ronald Reagan Boulevard. This property is located in Commission District #1.
5. Joni Owens ZA3500 Rezone from M1, M2 and RES3 to MPD (Master Planned District) on 166.22 acres for 913 mixed-type residential units with a density of 5.49 units per acre and 283,800 square feet of commercial space with a total of 2,782 parking spaces including residential parking. A total of 53.62 acres of open space is provided. Location: On the south side of Matt Highway (S.R. 369) approximately 1,200 feet west of the intersection with Dr. Bramblett Road and on the east and west sides of Dr. Bramblett Road approximately 750 feet north from the intersection with Byers Road. This property is located in Commission District #4.
6. Almquist Hansen, LLC ZA3502 Rezone from MPD to CBD for a total building area of 37,600 square feet with 155 parking spaces and a Conditional Use Permit (CUP) for a Senior Housing facility with 180 residential units on 18.015 acres. The applicant is also requesting a variance to the minimum senior housing parking requirements. Location: On the south side of Windermere Parkway at the intersection with Trammel Road. This property is located in Commission District #5.
7. Harold E. Crye Living Trust ZA3505 Rezone from A1 to CBD to develop a storm water detention pond to serve adjacent CBD property on 2.75 acres. The applicant is also requesting a variance to eliminate the 40 foot buffer imposed when abutting property zoned A1. Location: Set back approximately 230 feet south from property located on the south side of Keith Bridge Road (S.R. 306), approximately 1,600 feet southwest from the intersection of Keith Bridge Road (S.R. 306) and Browns Bridge Road (S.R. 369). This property is located in Commission District #5.
