III. Announcements

Pursuant to Section 8-3.4 (E) of the Unified Development Code of Forsyth County, the findings and decisions of the Zoning Board of Appeals shall be final unless a person aggrieved shall, within ten (10) days of such decision, petition the Board of Commissioners of Forsyth County to review the decision. At the end of the (10) day period, it shall be the responsibility of each applicant to check with the Department of Planning and Development to confirm whether or not such an appeal has been made.

Pursuant to Section 8-3.4 (B) of the Unified Development Code of Forsyth County, persons wishing to speak on any proposal shall provide their name, address, and telephone number to the Department of Planning and Development staff prior to the time of speaking at this public hearing. You may obtain a copy of this form in the foyer of this meeting room.

APPEALS
1. AP080001 - Mahaffey Pickens Tucker, LLP
This request involves an appeal of fines imposed by Forsyth County Department of Engineering.

The property is located in Pleasant Manor Subdivision, Lot #82, 3040 Ansley Arbor Court and is currently zoned (RES3) Single Family Residential Three Unit/Acre District. This property is in Commission District #4.
2. AP080002 - Scott Carriege
This request involves an appeal of fines imposed by Forsyth County Department of Engineering.

The property is located 5513 Old Atlanta Road and is currently zoned (RES1) Single Family Residential One Unit/Acre District. This property is in Commission District #2.
VARIANCES


1. VA080021 - Atreus Homes and Communities
This request involves an exterior yard variance of 35 feet to allow an exterior yard to be 15 feet rather than the required 50 feet.

The property is located on the north side of James Burgess Road approximately 312 feet east of the intersection with Audreys Way and is currently zoned (R3) Multi-Family Residential District. This property is in Commission District #5.
2. VA080023 - ACR Engineering, Inc.
This request involves a side yard variance of 30 feet to allow an addition to be built 20 feet from the side property line rather than the required 50 feet. The applicant is also requesting a buffer variance along the northern property line of 30 feet to allow a buffer to be 10 feet rather than the required 40 feet and a buffer variance along the western property line of 10 feet to allow a buffer to be 30 feet rather than the required 40 feet.

The property is located 5490 Atlanta Highway and is currently zoned (CBD) Commercial Business District. This property is in Commission District #3.
3. VA080030 - Clayton Churchill
This request involves a side yard variance of 9 feet to allow a deck to be built 16 feet from the edge of the right-of-way rather than the required 25 feet.

4. VA080031 - Bill Ryan
This request involves a side yard variance of 7 feet to allow an addition to be built 3 feet from the side property line rather than the required 10 feet.

5. VA080032 - Nancy Ann Higgins
This request involves a front yard variance of 4 feet to allow an addition to be built 36 feet from the edge of the right-of-way rather than the required 40 feet. The applicant also requests an exterior yard variance of 20 feet to allow an addition to be built 30 feet from the rear property line rather than the required 50 feet.

This request involves a side yard variance of 20 feet to allow a garage to be built 5 feet from the side property line rather than the required 25 feet.

This request involves a rear yard variance of 6 feet to allow a deck to be built 19 feet from the rear property line rather than the required 25 feet.
