The Forsyth County Water & Sewerage Authority will hold a Special Called Meeting on Thursday, February 16, 2017 @ 4:45 p.m. The meeting will be held in the Commissioners’ Conference Room, Suite 210 in the Forsyth County Administration Building located at 110 East Main Street, Cumming, Georgia 30040.

 

The purpose of the Special Called Meeting will be for consideration of items as outlined on the agenda and such other business as may properly come before the Authority.

On Thursday, February 16, 2017 at 4:49 p.m. in the Commissioners Conference Room of the Forsyth County Administration Building, the Forsyth County Water & Sewerage Authority held a Special Called Meeting with the following members present: Rick Swope – Vice Chairman, Laura Semanson - Secretary, Ralph J. Amos – Member, Cindy Jones Mills – Member and Tim Perkins – Member.

Todd Levent, Chairman, was absent during this portion of the meeting.

Also present: Doug Derrer – County Manager, Tim Merritt – Deputy County Manager, Ken Jarrard – Authority Attorney and Cindy Henderson – Clerk.

The meeting was called to order by Vice Chairman Swope.

UNDER ADOPTION OF AGENDA THE FOLLOWING ACTIONS WERE TAKEN:

There was a motion by Cindy J. Mills and a second by Laura Semanson to adopt the agenda as presented. Motion carried with five members in favor (Swope, Semanson, Amos, Mills and Perkins) and one member absent (Levent).

UNDER ADOPTION OF MINUTES THE FOLLOWING ACTIONS WERE TAKEN:

There was a motion by Cindy J. Mills and a second by Laura Semanson to adopt the minutes of the Called Meeting of January 19, 2017. Motion carried with five members in favor (Swope, Semanson, Amos, Mills and Perkins) and one member absent (Levent).

Chairman Levent arrived at the meeting.

UNDER OLD BUSINESS THE FOLLOWING ACTIONS WERE TAKEN:

None

UNDER NEW BUSINESS THE FOLLOWING ACTIONS WERE TAKEN:

(1) First Amendment to that Acquisitions Contract by and between the Forsyth County Water and Sewerage Authority, a body politic duly organized and existing under and by virtue of the laws of the State of Georgia (the “Authority” or “Buyer”), and Samuel L. Higginbotham a/k/a Sam L. Higginbotham a/k/a S.L. Higginbotham, in his individual capacity (“Mr. Higginbotham”), and Samuel L. Higginbotham a/k/a Sam L. Higginbotham a/k/a S.L. Higginbotham, in his capacity as Executor of the Estate of Juanita C. Higginbotham as presented. Motion carried unanimously.

There was a motion by Ralph J. Amos and a second by Laura Semanson to adjourn. Motion carried unanimously.
